Visitors would normally require a visiting visa except they are from a Visa-exempt country. To qualify for a visitor’s visa, an applicant must be able to demonstrate a good financial ability, good travel history, valid reason for visit, and adequate evidence of ties to home country.

Study Permit

Education is another pathway to immigrate to Canada. To qualify for study permit, a student must obtain a Letter of Admission from a designated Learning Institute in Canada. The admission can be for either Undergraduate or Postgraduate Studies. To qualify for study permit, an applicant must show evidence of being able to pay tuition and upkeep in Canada and prove to the immigration officer that he/she intends to leave Canada after their studies. In addition to the Study Permit which would usually be given at the Point of Entry to Canada, students would need a Temporary Resident Visa and/or and eTA (electronic Travel Authorization), depending on their country of citizenship or residence.

Upon graduation, the student becomes eligible to apply for post graduate work permit, which is an open work permit. One year of Canadian work experience in an eligible occupation qualifies the person to apply for permanent residency.

Work Permit

For any foreign national to obtain work permit in Canada, the job offer has to be approved by Employment and Social Development Canada (ESDC), except covered under some certain exemptions. For this reason, an applicant cannot just present an offer of employment to IRCC in order to get a work permit without approval form ESDC.

There are cases where a positive LMIA is not required in order to be eligible to apply for a work permit.

The following categories are exempt from requiring a positive LMIA- a work permit can be obtained without one.

Note: Being exempt from obtaining a LMIA does not mean the individual is exempt from obtaining a work permit. All streams on the LMIA exemption list still require the individual to obtain a work permit to work in Canada legally.
